BIFA Chapter 3 - Payment Claims

It is often difficult to determine whether a document that appears to be a claim for payment is, in fact, a valid payment claim given under chapter 3 of the BIFA. BIFA Chapter 3 - Adjudication Applications / Responses

If a payment claim is in dispute, or a valid payment schedule is not given within time, a claimant may elect to make an application for adjudication of that payment under chapter 3 of the BIFA. Strict timeframes apply as to when an application for adjudication may be lodged with the Adjudication Registry of the Queensland Building and Construction Commission. If a Respondent wishes to give an Adjudication Response to the Adjudication Application, it must do so within strict timeframes.
